Federal Judge Orders Trump Administration to Bring Back Deported Guatemalan Man
A federal judge has ordered the Trump administration to facilitate the return of a Guatemalan man, known as “O.C.G.,” who was wrongly deported to Mexico despite having legal protections.
Judge Brian Murphy of the U.S. District Court in Massachusetts ruled that O.C.G. was not given a proper chance to express his fear of being sent to Mexico before his removal.
Court records reveal that O.C.G. told immigration officers he had been raped and held hostage in Mexico, but his concerns were ignored.
Murphy emphasized the importance of due process and legal fairness, writing that while rules may be frustrating, they are essential for justice. He noted that the cost of bringing O.C.G. back is minimal compared to protecting the rule of law.
O.C.G.’s lawyers say he is currently in Guatemala, living in fear and unable to visit his mother due to threats from past attackers. He was forced to choose between staying in Mexico or returning to Guatemala after deportation.
The case highlights ongoing legal challenges to Trump’s immigration policies, focusing on procedural errors rather than the merits of O.C.G.’s fears.
Originally, O.C.G. was granted withholding of removal to avoid being sent back to Guatemala due to persecution, but officials failed to properly assess his fear of Mexico before deporting him there.
In a related case, another deported immigrant, Kilmar Abrego Garcia, alleged to be an MS-13 gang member, was also ordered back by the courts after being deported to El Salvador despite a pending case.
The Trump administration has not yet complied with these court orders to bring the men back, and the respective foreign governments have not cooperated either.
Legal experts believe these cases could set important precedents for how courts address disputed deportations in the future.
The ruling has drawn criticism from conservatives who say judges are overstepping and hindering immigration enforcement, while supporters say it’s about upholding constitutional rights and legal protections.
O.C.G.’s legal team plans to push for full consideration of his claims about dangers in both Guatemala and Mexico.
For now, the Trump administration is under a court order to arrange O.C.G.’s return to the United States.
