JUST IN: Official Investigation Launched Into Jack Smith

The Office of Special Counsel has officially launched an investigation into former DOJ special counsel Jack Smith — the man behind two high-profile prosecutions of President Trump. This marks the first formal legal inquiry into Smith’s own conduct.

As many remember, Smith led the Biden-era investigations into Trump’s handling of classified documents and his role in the January 6th Capitol incident. Both cases have since been dismissed. Now, Smith himself is under scrutiny for possibly violating the Hatch Act, which bars federal employees from using their positions to engage in partisan politics.

The investigation comes after Senator Tom Cotton submitted a formal complaint, urging the Office of Special Counsel to examine whether Smith weaponized the justice system to interfere in the 2024 presidential election. The Hatch Act Unit has since opened a case, confirming the probe via internal communications reviewed by The New York Post.

Senator Cotton outlined several actions he says show clear political motivation. These include:

  • Pushing for an extremely accelerated trial schedule for Trump — demanding jury selection just weeks before the Iowa caucuses, giving Trump’s legal team only a few months to prepare for trial despite millions of pages of evidence.
  • Bypassing standard legal procedures by petitioning the Supreme Court directly in December 2023, aiming to fast-track the case ahead of the election — without offering a compelling reason for the rush.
  • Filing irregular and unusually long legal briefs close to the 2024 election, in ways that may have violated the DOJ’s own rule against taking politically sensitive action within 60 days of an election.
  • Publicly including grand jury materials typically kept confidential, raising concerns that Smith may have used court filings to shape public opinion and damage Trump politically.

Senator Cotton argues that these actions weren’t about justice — they were strategic moves to damage President Trump’s chances in 2024. He concludes by insisting that even though Trump went on to defeat Biden and others who tried to politically sabotage him, Jack Smith should still be held accountable for abusing his position.

“No one is above the law,” Cotton said — a sentiment echoed by many now closely watching this new investigation unfold.
